1. Service Description
Mochipal is an AI-powered virtual pet companion app for iOS. The app provides an interactive digital pet (“Mochi”) that reacts to your voice, facial expressions, touch, and text messages using artificial intelligence.
2. Acceptance of Terms
By downloading, installing, or using Mochipal, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the app.
3. Service Tiers
Mochipal offers two service tiers:
- Free — 5 messages to Mochi per day, 10 memory facts, basic interactions and touch
- Premium ($8.99/month or $79.99/year) — unlimited messages, 200 memory facts, ambient listening, face awareness, richer AI personality
4. Acceptable Use
You agree not to:
- Reverse engineer, decompile, or disassemble the app
- Use the app for any unlawful purpose or in violation of any applicable laws
- Attempt to gain unauthorized access to our servers or services
- Use the app to generate harmful, abusive, or inappropriate content
- Interfere with or disrupt the app's functionality or servers
- Redistribute, sublicense, or commercially exploit the app without permission
5. Billing & Subscriptions
- Premium subscriptions are billed through the Apple App Store.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
- You can manage and cancel your subscription in your Apple ID settings.
- Refunds are handled by Apple according to their refund policies.
- Free trial periods, if offered, automatically convert to a paid subscription unless cancelled before the trial ends.
6. AI-Generated Content
Mochipal uses artificial intelligence to generate pet reactions, responses, and personality. Please note:
- AI responses are generated for entertainment and companionship purposes only.
- Mochi's responses should not be considered professional advice (medical, legal, financial, or otherwise).
- AI-generated content may occasionally be inaccurate, unexpected, or inappropriate despite our best efforts to ensure quality.
- We continuously improve our AI systems but cannot guarantee perfect responses.
7. Your Content
You retain ownership of any text or voice input you provide to the app. By using Mochipal, you grant us a limited license to process your input solely for the purpose of generating pet responses. We do not use your content for training AI models.
8. Privacy
Your use of Mochipal is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
9. Intellectual Property
All content, design, characters, artwork, sounds, and code in Mochipal are owned by Mochipal and protected by copyright and intellectual property laws. The Mochi character, animations, and ASMR sounds are original creations.
10. Termination
- You may stop using Mochipal at any time by deleting the app.
- We reserve the right to suspend or terminate access to the app if you violate these terms.
- Upon termination, your locally stored data remains on your device until you delete the app.
11. Disclaimer of Warranties
Mochipal is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the app will be uninterrupted, error-free, or free of harmful components.
12. Limitation of Liability
To the maximum extent permitted by law, Mochipal shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the app, including but not limited to loss of data, revenue, or profits.
13. Changes to Terms
We may update these Terms of Service from time to time. Continued use of Mochipal after changes constitutes acceptance of the updated terms. We will notify you of significant changes through the app.
14. Governing Law
These terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
